WHY DIDN'T THEY SETTLE  

Based on the statement by Disney following the settlement (glowing towards Gina, and apologetic in tone even while not technically so), I'm guessing the rabbit hole goes deep for cataclysmically-bad, nearly company-ending info and communication found in discovery at LF/Disney (were any to make it into public record through trial).

And based on Gina's glowing statement, I'm guessing she and her legal team got a payday so enormous it'd be as if Bob Iger was buying another IP alongside Marvel and the Star War.  When this all kicked off it seemed the public word once Elon got into the mix was that no settlements would be happening and a trial was inevitable (though that expectation with Elon being so mercurial is probably not the best of bets).

Yes it's a little hyperbole on my part sure, but quite likely the actual settlement for Gina and her legal team was many millions, a "sacrilegious amount of money" as Patton Oswalt once coined.  I'd have rather they go full retard to turn the screws on Disney and refuse settlement entirely, but alas
