If they didn't allow recording of the demo to avoid unfavorable footage of the game in an earlier state, why even demo the game? Contractual obligation? If the game is dipping to 10-15 FPS in the open-world in an open-world game then don't show it, now they've earned the 'Elden Ring on Switch 2 is not good' thumbnails that will be plastered on forums to fuel cherry-picked analysis that ignores the other high-quality PS4 ports. It's difficult to wipe the stench of a first bad impression.
