I don't know the grounds for the murder one charge however, that would indicate they made the case that he took the knife with the intent of doing it and was just waiting for a provocation.

Apparently Texas does not have degrees of murder, so it wasn't "first-degree murder" only murder, they only had to show intent. Considering the parade of witnesses and zero friendly ones this was likely not difficult.
