they didn't have any choice
the virtual console made every single developer with a back catalog go
they are all selling their titles themselves in their own packages, they have no reason to give nintendo a big cut to appear on their service
that's why NSO is all the shitty table scraps that nintendo owns like urban champion or companies that literally don't care at all
konami, capcom and square have no reason to give nintendo 30% of their proceeds or whatever, not when they can sell FF classics, dragon quest remakes, castlevania collections, mega man collections etc
