I guess pinning this thread on Era didn't work. I wonder why?  it is a mystery

Haha. I knew this was about the El in Philly even before I clicked through to the OP. It really is a dystopian nightmare. I’d rather walk.

Whelp, looks like the reeing over Palworld begins. Probably will see more since right now it is clear by the Steam CCU that gamers don't care and Nintendo's bogus lawsuit had basically backfired on them.

I used to be a proud non funko pop haver but when the young nephew is so excited that you introduced him to What About Bob that he buys you the Bob funko pop you must accept it gracefully

you know what else is kinda funny, they love Muppet Christmas Carol (as anyone should) and as we were watching What About Bob I was like wait...this music sounds oddly familiar in some ways, just the way it's orchestrated, the way it flows

and I looked it up and What About Bob and Muppet Christmas Carol were both done by the same musician, Miles Goodman, only a year apart...makes sense since they're both involved with frank oz

and I swear you can hear little similarities

Quote:Definitely not my take as someone who likes Palworld!

When it came out, I was like "damn that looks like the very hot Ark + creature capturing game I've been dreaming of......others have tried, but they all fizzled in development. It's clearly pokemon inspired creatures with a cool open world sandbox survival world/loop like Ark, hell yeah!"

There was an element of "okay clearly they've vetted that these designs aren't actually violating any of Nintendo's IPS -- that would be *hilariously stupid* if not. They look similar, but I can go pull 5 other 'creature capture' games with gameplay loops much more similar to Pokemon than this that have some designs that are QUITE similar to Pokemon, and they've existed for years....probably gonna be fine, but we'll see!"

Then, we had the social media storm that eventually lead to Nintendo declaring that they were going to scrutinize the game heavily as requested and sue if they deemed anything to be infringing upon their IP. Amidst that, we had people posting things on twitter saying that certain models were DEFINITELY full "okay they just copy pasted this model from pokemon and added a few frills"......and I was like "oh damn if that's true......they are just the dumbest ever! corporations can be real dumb, so it's possible".

But, those allegations were wrong. The most popular one (the dog pal that.....looks like a dog pokemon woah!) was specifically retracted with the author saying he spoke too specifically and did not actually have evidence that it was a model ripoff (the internet ran wild with it and said it definitely was -- the zeitgest never updated to 'whoops I lied'......because that's how hivemind internet stuff works sadly).........it was just a fantasy dog model, that looked like another fantasy dog model.

What SHOULD have been the final nail in the coffin: Nintendo's lawsuit. The one that.........at no point ever attempted to argue that Palworld was ripping off their creature designs. An absurdly valuable IP by a very litigous company........did not assert in any way shape or form that these Pals were ripoffs, and definitely not "full model ripoffs" as the (false) statements alleged. They instead, wound up suing for the........generally silly gameplay patents like "we invited the idea of riding a fantasy horse that can also fight stuff". Whether you consider that valid or not, doesn't really matter for this discussion! It was all gameplay mechanics, nothing about Pal vs. Pokemon designs.

Unlike "random dudes on twitter and forums".....Nintendo has access to essentially infinite resources for the purposes of suing someone and proving that they blatantly ripped off 'mons with their pals. Discovery is a thing and it would be incredibly easy for Nintendo to compel Pocketpair to produce the full byte by byte data of how they came to get design and create the models for their pals. To protect the most valuable IP in the world, they would do it in a heartbeat!

They.....did not do this.

Do the math on that one -- it's not complicated. All we have now for "proof" are....people on twitter, reddit and forums authoritatively saying that they eye tested that these designs are definitely Pokemon ripoffs. If you.......know anything about "eye tests"....you should know they're essentially the most unreliable, confirmation bias prone evidence that exists. In our information dystopia of 2026 internetland.......they're essentially the last leg you stand on when all better forms of evidence have been tried and been found to be false. Before the twitter "proof" was retracted -- it was their hard evidence that proved Pocketpair was definitely going down. Now that they were retracted......well it doesn't matter, "we all have eyes", and that's all the evidence needed to keep on going, all verifiable evidence be damned.

It's 2026 in a nutshell -- "yes all of these IP experts and lawyers agree it's NOT copyright infringement, it's not plagiarism, Nintendo themselves isn't even alleging that *while suing Pocketpair* -- but my gut, my friends, and some loud people on the videoscreen say it is. So it is, and I will say that until my dying day."

I remain the crazy person deferring to experts in complicated situations like this, allowing my opinion to change as evidence is introduced/confirmed/refuted, understanding that looking at a model and having it look similar with "eye test" does not mean it's "definitely plagiariasm" and......... hey I'm at least used to being on an island with this stuff as it's an issue much larger than videogames, pokemon, and Palworld in our current crazy political climate information dystopia. Climate change is fake because I saw a snowball, scientists are all liars and you should trust your loud uncle who "heard some things on the internet", etc. etc.

Jesus, resetera's ability to radicalize people into performative tankies is almost undefeated

This is like the flashback scene in SLC Punk! when we realize that all of the punks were actually just middle-class adolescent D&D nerds a few years earlier. All of this revolutionary shit is just a front for someone deeply insecure and lacking real-life agency.

This government is a plague on trans people.

Unfortunately Burnham has said that he feels the matter is settled, "the time has come to take the Supreme Court ruling and the guidance and implement it" and that "we've got to move into the next phase and not constantly re-running the arguments". So I don't have any hope that we will see change under him when his first response on the matter was to immediately u-turn on past positions and agree that we need to introduce segregation of trans people. That anything else would be to be 'arguing'.

Bire fav plagiarize with some insight.
plagiarize wrote:The trap people keep falling for with legislation like this is to look at it and go 'well both sides seem unhappy so it must be fair' when the transphobes can literally never be happy with any plausible outcome.

It should be plainly obvious that you need to ignore people like that. They don't want trans people to exist, but we do, and will continue to, no matter how cruel the measures taken are. They want an impossibility, they want reality to bend into the overly simple binary they were taught so they don't have to feel any way about trans people or non-binary folks. Can't be called a bigot towards something that doesn't exist... never have to self reflect.

But we arent a belief that can be stamped out, we are part of the natural world, and giving those ghouls *anything* is just needless cruelty. Even when they arent interacting with any openly transgender people they imagine cis people are trans and go on witch hunts.
