I think one thing that must be understood is that we're not starting this conversation, or whatever conversation is to actually be had, in a vacuum. We live in a white supremacist society and thus people have been trained to be servile to it at a minimum. The reflexive defensiveness of people towards a neutral reminder of the holiday's genocidal origins is symptomatic of this servility because the reminder itself serves as a critique because it is pointing out the status quo, the current reality, as a bad thing, and "good" people don't like being reminded of their potential complicity in bad systems. They want to divorce themselves from it, to pretend like Indigenous genocide is just water under a bridge and something that happened forever ago, and not a reality they're just not thinking about because society has taught them to not think about it, to not question it, and certainly not to fight it. Don't ever dare fight it.

Imagine someone getting angry over the fact that you said that water is made from hydrogen and oxygen; you would question then what thus basic fact, or the statement of this basic fact, poses a threat towards.

Ultimately, there is no "good" way to discuss this because there is no "good" way to critique extant social structures that people are emotionally attached to maintaining, because the maintenance of these systems ensures what little peace they've carved out for themselves can potentially be preserved.

That whole Thanksgiving argument is premised on the idea that being an asshole to family members and accusing them of sins will cause them to not just change their behavior but devote themselves entirely to changing society. Having done Jury service with people I wouldn't trust to be able to open an automatic door and others who just go with the majority because they want to get home as soon as they can I'd say there's got to be a better system for cases that are suitable complex or come with heavier sentences.

Good thing. Imagine every fucking moron you encounter in daily life. There are a lot of fucking morons out there. Now imagine a jury filled with them. That's happening every day.

Gonna echo the people saying that not having a jury is fine and even preferred for most cases (the less serious ones, usually).

That's kind of how I feel about it, and I'd imagine 99% of people called up don't want to be there either.

It may have that now, but it's basically a gentleman's agreement that the governments there don't act capriciously in cases not subject to jury trial. It only works because people have faith in the system and because the system mostly that faith. But any nation that doesn't guarantee a trial by jury is only one authoritarian-minded leader away from just being able to throw whoever it wants in prison. I shudder to think about what would happen if judges in this country could just decide guilt at their own discretion and toss people into prison for minor offenses, with no jury involved.

I will always be of the opinion that in all criminal proceedings the deck must always be stacked against the state, that there must always be barriers in place to make conviction as difficult as possible. "Better to let ten guilty people go free than to convict one innocent person."

Oh ok, so how do Jury trials currently help people being kidnapped by ICE? I´m sure they are happy about their jury trials before they get deported to god knows where.

Juries are important in historical terms as an advance from being tried by your local feudal lord.

In modern western democracies, bench trials are almost always superior, both in terms of speed and results. Judges have to actually explain the reasons for their decisions, and trials are much simpler and quicker when they don't have to laboriously filter things for jurors.

Interesting that this kind of thing doesn't get the same attention from the forum prison abolitionists as Thanksgiving does.

So, as crime has generally been going down, and to my knowledge, thay haven't made legal processes more complicated or lengthy recently, this all comes down to Austerity and the gutting of Public Services, right? Now, rather than doing the hard work of rebuilding it and funding it properly, they are just going to chop off accountability and checks, and simply streamline things without regard to best practice.
