Actually, it's not and he's partly right that Alito is just trolling. Title IX says "sex" so woman is just a different word for female and the attorneys should be arguing why males should be allowed in the female class.

I should perhaps clarify that the trans side is supposed to be arguing at the Court that separating teams by sex, aka Title IX itself, is unconstitutional and violates the 14th Amendment. That's the question presented for the case. Everyone knows the Court is not going to destroy women's sports so we have to do this stupid shit to bail out the side that's literally bringing a dishonest argument to the Court.
