All things considered, that specific use case sounds like one of the more ethical ways a company could use the tech, if they're providing the dataset themselves with content that they own instead of using the tech as an art theft tool.

This post is so ignorant it's laughable. I work at a F500 fintech company and the last few months upper management has been giving teams access to Claude to assist with their work. In addition to that we now get our usage tracked as its own metric.

Point being devs at work don't use AI because "we suck". What a childish thing to say. It's about efficiency. We have deadlines to complete and sometimes can't afford to spend hours Googling or searching Stack Overflow for the answer on how to do a certain thing.

And you can bet that the devs at your favorite studio are probably using AI to assist with coding since the pressure to finish projects more prevalent in the gaming industry. Someone mentioned 90% but I'd say 95%. Any development team not using it is just handicapping themselves at this point.

Especially now with the rise of generative AI the legislation is moving to a more strict direction on what is considered CSAM.

CSAM is sexually explicit content involving a minor or content involving a minor designed to illicit arousal. Again nudity alone is not sexually explicit content. If you're familiar with CSAM then you should know this. Otherwise communal showers, locker rooms, nude beaches and bath houses would be illegal.

I'm responding to your post dismissing CSAM concerns by saying fictional depictions aren't considered CSAM. The law says it doesn't matter if the children aren't real and video games are not exempt. It doesn't matter if it's CGI or cartoon. It's still illegal.

Either way it's not hard to see why Valve wouldn't be interested in putting themselves in a position where they have to defend their decision to distribute this content and explain to the courts the serious value they see in a child riding a naked adult crawling on all fours with an animal mask.

The post I was responding to made the assertion that regardless of context "it doesn't change the fact that the material depicted CSAM". Which is, quite frankly, a load of bullshit. As the very law you quoted said, context does matter and I would absolutely argue that that it did not depict CSAM, even before it was changed. My "its just a fucking video game" reaction was due to the fact that the website they quoted was talking about very real child abuse where there is no room for this kind of interpretation or context.

Valve being unwilling to allow this content on their platform while allowing anime games that depict rape where all the characters look exactly the same age as a generic middle-school anime protag just because the devs claim all the characters are over 18 is ridiculous.

It is also ridiculous to not allow them to resubmit the game after the content was changed, this is an established developer, Valve have no reason to believe they are going to go behind their backs after launch and release a patch that changes the content back. Even the developers agreed that changing the characters depiction to an older woman fitted the scene better in the end: "The scene is not sexual in any way, but it is possible that the juxtaposition is what triggered the flag. We have since changed the character in the scene to be a twenty-something woman, both to avoid the juxtaposition and more importantly because the dialogue delivered in that scene, which deals with the societal structure in the world of Horses, works much better when delivered by an older character"
