He was smarter than someone like Mercante because a lawsuit about hurt feelings or defamation is rarely a sure fire thing. Instead he focused on copyright and as I understand "react content" has always been quite the gray area for streamers.

Defamation is well-known to be extremely difficult as the basis of a lawsuit, nobody ever succeeds suing for defamation. 
 
As for a copyright lawsuit? Yeah, these streamers are cooked. Frogan is the only one taking this seriously by shutting the fuck up while the other two are either too stupid to understand the deep shit they’re in or they’re panic crowdfunding to pay for their legal fees.

Mercante isn't going to succeed in her defamation case because all the "defamation" is stuff she herself posted. She claimed to be a sex worker endlessly (and it's easy to find her content), now is suing that guy for saying she was a whore. And she posted multiple times refuting the claim in her lawsuit that it was the defamation that caused her to lose her job. She continues to do that even after filing the lawsuit.

She also hired a law firm that's specifically about harassing people online with lawfare. They don't care about winning. That's why their one filing didn't make any sense and they had to  resubmit it after the court read it.

That said, Ethan's lawsuit is not exactly a truly legit one, he'll only get token damages.
