Downloading works, curating them into a training dataset, and training on that dataset generally involve using all or substantially all of those works. Such wholesale taking ordinarily weighs against fair use.

And their citation for this brief and definitive statement comes from fucking Karla Ortiz in her almost-completely-thrown-out-of-court lawsuit, who could not have known whether what she was saying was even true or not:

copyright doesn't work on fruit of the poisonous tree, you can see a painting, be inspired by it, and make a new painting that doesn't use anything from that first painting, and it doesn't matter that you "absorbed 100% of the first painting" to contribute to the making of the second, all that matters is the content itself

A new entry in Planetsmasher's Big Book Of Things That Definitely Happened

When I was a teenager I got dragged to the Boston Symphony Orchestra for a school trip to see some kind of opera, and they set me up in the front row of the top balcony, which was EXTREMELY close to the edge. At some point during the show I blacked out for a few seconds, and when I woke up I was leaning forward with the top part of my body dangling over the guardrail. I was extremely lucky I woke up when I did, because I don't think it would've taken much effort to send me sailing over that edge into the audience below me.

All that is to say that this has been a fear living in my brain ever since that day. I don't know what specific circumstances led that dude to fall off the balcony himself but it's something that's lived with me for a while. I get that upper-level balconies can't have super high guardrails in order to ensure the people sitting in them can actually SEE the stage, but I wish there was a more elegant (and safe) solution.

Pretty sure it’s shiba5.  If you go to https://www.resetera.com/threads/active-staff-roster.7164/#post-1191462 you can click on all the other names and it pops up their little user card or whatever, but shiba5 does nothing which makes me think the account was nuked for some reason.  I know I saw the name recently too so definitely still active.

Edit: Yea shiba5’s account has been nuked, if you try to go back to a post that another user quoted it just says post not found. Now I’m more curious about what happened that it necessitated a full account nuke to hide.
