I found a Snopes article, because running interference for Hasan is just what they do now, I guess.

The lynching comment is certainly out of context, but the other stuff about “fuck what black people think” is really not in the least bit improved by being seen in context. It’s exactly what it looks and sounds like.

Hasan can afford an attorney good enough to tell him that you probably shouldn't sue because somebody who hates you believed your sarcasm in a clip from a montage of your statements. (Especially when you won't be able to show any damages which is required in lawsuits.)

But considering some of his other hires and reliance on his uncle's connections... (His uncle whose among his years of expressed wise legal expertise led him to believe he could sue to overturn the Constitution barring foreign-born people from being President.)

I'm surprised he has no case at all because what Jennings said was fairly defamatory, if it happened here we'd have had some kind of apology by now I think. But I suppose, actually, Jennings moving closer to the president probably does ensure that any legal action is a waste of time, given the banana republic in discussion.

Wish I'd never learned about Hasan or streaming on the internet or politics.

To avoid dismissal, Hasan would have to demonstrate:
1. Jennings absolutely knew that part of the montage was sarcastic unlike the rest and decided to proceed anyway, rather than just being an idiot who rushed to condemn something he believed fit Hasan's pattern.
2. Damages, of which Hasan has none.

Because it's Jennings just posting his own nonsense on Twitter or whatever the fuck this is from, he doesn't have the burden as if he was doing it in his already pretty low capacity as a commentator at CNN or whatever. Which is why CNN employs factcheckers, lawyers, etc. "I'm an idiot posting shit on Twitter" is largely a good defense and why you rarely see any lawsuits at all over tweets, especially when it involves public figures. Millions of tweets a day are defamatory by the standard of merely what was said but they pretty much always fail the other two standards of defamation, duty to know the truth and damages. This is, coincidentally, why much of what Hasan says about others (that you can see brought up in the replies of all of these tweets) is also protected.

If Hasan filed in California he would potentially be risking a SLAPP requiring him to pay Jennings lawyer fees. California has one of the strongest SLAPP statutes.
