It really does speak to the asymmetry by which both parties are expected to maneuver.

A lot of the media and pundit class expect Republicans to break the rules and skirt the rule of law when it suits them. And it is that very expectation that inoculates them from ever paying any sort of long-term political price. They may lose an election here, a court case there, but overall it's just memory holed as Republicans doing what they do.

But Democrats? They're expected to play by the rules. They're expected to abide by checks and uphold norms. And so when they don't…the blowback is intensified. And it comes from ALL sides.

It's a cycle I've lost all hope of escaping.

If you're a trans woman with any conviction for a violent or sexual offense, or have a penis, you go to the men's prison regardless of a Gender Recognition Certificate
If you do have a GRC (which requires all of this and is currently being decided in court if it even matters) you will be held separately within the men's prison
If you've had bottom surgery but don't have a GRC, you're still sent to the men's prison
If you're a trans man you're sent to the prison of your legal gender

There's also the unspoken fact beneath all this posturing isn't efforts to prevent sexual abuse within the prison system. Instead it's that they operate under the barbaric belief that anyone they deem to be a man who is also in the prison system deserves to be sexually assaulted or raped. That's just part of the prison culture and the punishment of being sent to a men's prison.

There's also that little problem of finding places to keep trans women in a separate space while the prison system is, y'know, full. Which is probably why you need a GRC to be recognised as a trans woman, they know full well there's remarkably few, if any trans women with a GRC in the prison system, its just the thinnest veneer of performing respect for trans women while calling them all dangerous men.
